Car repossessions went up 43% over two years as high prices squeeze Americans.

Repossessions are the third rail of the auto industry. They’re expensive, complicated and sometimes traumatic. They require a significant expenditure of time and energy from lenders, third-party forwarding companies and repossession agents. As myriad factors keep vehicle prices eye-wateringly high, repossessions are becoming more common. High costs to the consumer are finishing their boomerang arc, kicking up additional costs and complexity for the industry.
\n“Repossession is just an absolute last resort,” said Danielle Arlowe, senior vice president at the American Financial Services Association, which represents the consumer credit industry. “I don’t think that some people realize just how much creditors do not want to repossess a vehicle.”

\nVehicle prices remain high and affordability is a top buyer concern. Many drivers are turning to extended loan terms that result in lower monthly payments but higher overall costs and more risks down the road. Here is the share of auto loans with terms of 84 months or longer over time.

Repossessions Are Rising
\nAffordability issues are the talk of the auto industry.
\nThe average transaction price for a new vehicle exceeded $50,000 for the first time ever in September. A record 24 percent of borrowers took out auto loans that span seven years or longer in the second quarter, according to Edmunds. In March, default rates rose to their highest levels since the Great Recession in 2010, and the number of defaults from January through March rose 9 percent from a year earlier, according to Cox Automotive.
\nWhile the data suggests high costs are leading to significant hardship for consumers, nationwide statistics on repossession across lenders, states and outcomes are scant.
\nIn general, adjacent data suggests repossessions are growing more frequent, lenders, agents and economists told Automotive News. For example, Manheim, a major vehicle auction marketplace, reported that the volume of vehicles at auction from repossessions for the first half of the year is up 11 percent from last year and 36 percent from 2019 (though part of that growth is Manheim’s securing a greater share of the repo business).
\n“Consumers are constantly pulling out of one pocket to pay the other pocket in terms of these growing costs,” said Jeremy Robb, chief economist at Cox Automotive. “We’re definitely seeing more defaults; more defaults typically lead into seeing more repossessions.”
\nWhile most consumers will never experience a repossession, auto debt is a part of American life.
\nAbout 60 percent of new-car buyers got loans to purchase vehicles in the first quarter, according to Experian. Nearly 40 percent of used-vehicle buyers did.
\nThat means that while consumers drive vehicles with jam-packed trunks and decals of stick-figure families pasted to the windows, many cars still belong to lenders until drivers pay them back.
\nThe largest auto lenders in the country include Toyota Financial Services, GM Financial, Ally Financial, Chase Auto, Capital One Auto Finance and Ford Motor Credit. Buy here, pay here servicers such as CarHop, DriveTime and Byrider also provide loans to consumers and collect the collateral when debtors default.
\nThe average monthly car payment in the U.S. was $777 for a new vehicle and $576 for a used vehicle for loans originated in the second quarter of the year, according to Edmunds. The amount financed, interest rate and length of the loan help determine the monthly payment.
\nWhile lenders in some states can technically initiate a repossession the moment the loan or credit account is delinquent, many pursue the collateral once a debtor is 90 days past due.

Lenders Try To Avoid Repossessions
\nLenders generally lose money on repos, as the cost of issuing the loan and repossessing the car exceeds the value earned at auction. For example, Toyota Financial Services loses an average of $13,602 per repossessed vehicle, according to its latest financial filings.
\nLenders also make expensive and damaging mistakes by failing to verify titles, registrations, military status and more, resulting in wrongful repossessions, consumer harm and lawsuits, though there is no federal data on the frequency of wrongful repossessions.Repossessions can be devastating to consumers. Many Americans use their cars as their primary transportation to work.
\nTheir credit scores often plummet, and a repossession mark stays on credit files for seven years from the date consumers stop making payments. The vast majority of consumers — 94 percent from 2018 through 2022 — retain deficiency balances after the repossession, meaning that the proceeds of the sale do not cover the amount owed to the lender, according to the Consumer Financial Protection Bureau.
\nWorse, some consumers aren’t even in default, and their cars are repossessed anyway.

Compliance Issues Remain Problematic
\nAgents and lenders stress that wrongful repossessions are fodder for their worst nightmares and are exceedingly rare. Still, despite efforts to clamp down on mistakes, systemic issues have persisted for years, leading to illegal, painful and costly wrongful repossessions.
\nAgents complain of a breakdown in communication that can lead to errors. For example, James Waldron, president of 1st Adjusters in Texas, said that wrongful repossessions can happen when license plate readers scan a plate that is matched to a delinquent account, but in fact the car has already been repossessed and bought by a legitimate buyer at auction.
\nPersonal injury attorneys representing victims of wrongful repossessions also described this trend to Automotive News. Many of these cases settle and involve confidentiality agreements, precluding on-the-record interviews.
\nMany states, including New York, Pennsylvania, California and Texas, restrict access to department of motor vehicle records, preventing agents from checking whether a title has been transferred.
\nIn other cases, the industry’s reliance on third-party forwarders can muddy the waters, agents said. Plants, of New York Repo, compared the forwarder issue with a game of telephone. For example, if a debtor makes a payment, that information has to make it from the lender through a middleman to get to the agent.
\n“It just increases the length of time it takes until the actual guy in the field with the tow truck is aware the repossession assignment needs to be canceled,” he said.
\nLenders sometimes fail to check the debtor’s active military status. The Servicemembers Civil Relief Act holds that if a borrower in the military makes a payment on a loan and then is sent to active duty, there are additional conditions that have to be met to repo the vehicle. That’s meant to protect service members from repossession while they are defending the nation, since they may miss payments as a result of travel, communication blackouts or injury.
\nLenders and lawyers that represent them said logistical challenges, including gaps in data reporting, also complicate this process.
\nSince 2011, the U.S. Department of Justice has won more than $489 million for more than 152,000 service members through its enforcement of this law. CarMax agreed to pay almost $500,000 in February to resolve allegations it illegally repossessed at least 28 service members’ vehicles.

Enforcement Is Changing
\nThe Trump administration has disinvested in the Consumer Financial Protection Bureau. That means there are fewer checkups on financial institutions, said Brad Lipton, a staff attorney at the bureau from 2013 to 2025.
\nOther parties are stepping in to fill an enforcement void. That puts differences in state laws and enforcement in the spotlight, including disparities in records access, licensing requirements and liability.
\n“It’s a legal land mine right now,” said John Possumato, CEO of DriveItAway Holdings, which offers open-ended vehicle leases in part to avoid repossessions. “If I was a funding institution facing repossession, I’d be more scared today than I think at any point that I’ve been in the business.”
\nIn February, Massachusetts Sen. Elizabeth Warren, a Democrat, wrote to lenders asking them about their practices to avoid errors and requesting information about repossession mistakes from 2022 through 2025.
\nGeorge Fussell, CEO of the Southern Auto Finance Co., a lender, warned attendees at April’s Used Car Industry Summit in Miami that the Consumer Financial Protection Bureau may be “defanged” for now, but that won’t last forever.
\n“For anybody that’s relaxed about the CFPB and what it stood for, you might remember when the CFPB was first in power … they went back five and seven years looking at what lenders did,” he said. “You could pay the consequences of what you’re doing today five years from now.”

In 2026, a Houston woman gained viral fame for successfully blocking a repossession attempt by parking her Chevy Tahoe sideways inside her garage. By positioning the SUV parallel to the back wall, she created a physical “impossible” angle that prevented a tow truck from hooking the vehicle without damaging her home. Since repo agents are legally prohibited from “breaching the peace” or causing property damage, the agent was forced to leave empty-handed after multiple failed attempts, which may not work out for you in the end anyway.
\nFrustrated by the wasted time and resources, the repossession company eventually sued the woman for $2,500 in lost wages and expenses. While many on social media praised her clever parking strategy, a judge ultimately ruled against her, determining that she was intentionally obstructing a lawful repossession. She was ordered to pay the legal fees and the remaining balance on the car, proving that even “elite-level parking” couldn’t bypass her contractual obligations.
